Robert Mueller Has a Money Problem

Congress’s oversight on how to fund his office casts doubt on every conviction he wins.

Robert Mueller has delivered his report, but there’s a defect in how his investigation was funded. Unless Congress fixes it, any prosecution by Mr. Mueller’s office may be invalid.

Instead of asking Congress to appropriate money for Mr. Mueller’s investigation, the Justice Department funded it out of an unlimited account established in 1987 to pay “independent counsels.” The problem is that Mr. Mueller is a special counsel, not an independent counsel.

It isn’t surprising that this funding issue has gone unnoticed. The Justice Department made Mr. Mueller only the second prosecutor ever subject to the post-1999 special-counsel regulations—which, as the department itself acknowledges, contain provisions inconsistent with independence. Thus the independent-counsel fund shouldn’t be covering Mr. Mueller’s investigation.
Absent a legislative cure for this problem, his targets may have the ultimate trump card.
